{"id":3581,"date":"2020-08-11T16:15:04","date_gmt":"2020-08-11T16:15:04","guid":{"rendered":"http:\/\/chicagocouncil.org\/?p=3581"},"modified":"2020-08-11T16:15:08","modified_gmt":"2020-08-11T16:15:08","slug":"081120-chicago-tribune-excellent-news-about-kim-foxx-policies","status":"publish","type":"post","link":"https:\/\/chicagocouncil.org\/staging\/1601\/081120-chicago-tribune-excellent-news-about-kim-foxx-policies\/","title":{"rendered":"Chicago Tribune Reports Excellent News about State\u2019s Attorney Kim Foxx\u2019s Reformist Policies (Even if they Framed it as an Attack)"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"alignright size-large\"><img decoding=\"async\" width=\"265\" height=\"183\" loading=\"lazy\" src=\"https:\/\/chicagocouncil.org\/staging\/1601\/wp-content\/uploads\/2020\/04\/square-collab-for-footer.png\" alt=\"\" class=\"wp-image-3484\"\/><\/figure><\/div>\n\n\n\n<p>Both this morning and yesterday, the&nbsp;<em>Chicago Tribune<\/em>&nbsp;published an&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/opinion\/editorials\/ct-edit-chicago-looting-lightfoot-foxx-20200810-4ilsehywrbb3hfo5tgf6fy26iq-story.html\">editorial<\/a>&nbsp;and an&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/investigations\/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html\">analysis<\/a>, respectively, attacking bail reform in Cook County and the State\u2019s Attorney\u2019s (SA) felony dismissal rates. The information published in their&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/investigations\/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html\">report<\/a>&nbsp;on SA Kim Foxx&nbsp; is well-analyzed, and \u2013 despite the&nbsp;<em>Tribune<\/em>\u2019s best efforts to paint it negatively (and double-down on that criticism in their editorial) \u2013 is an overwhelmingly positive sign that&nbsp;<a href=\"https:\/\/endmoneybond.org\/2020\/08\/11\/ending-money-bond-makes-black-lives-matter\/\">bail reform works<\/a>&nbsp;and that Kim Foxx is delivering on her campaign promises and setting the priorities of her office to focus on public safety.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The&nbsp;<em>Tribune\u2019s<\/em>&nbsp;own analysis of SA Foxx\u2019s data shows that she is committed to holding police accountable for their conduct, expanding diversion opportunities for non-forcible felonies, and being judicious about whether charging someone with a felony is the appropriate response when that person or crime does not pose a physical threat to anyone.<\/h4>\n\n\n\n<p><strong>The job of a prosecutor is not only to win cases, but to fight for justice and community wellbeing.&nbsp;<\/strong>Part of this job is to decide what charges to pursue in the first place; another part is to decide if bringing charges is justified&nbsp;<em>at all<\/em>. Anytime a person is charged with a crime, tremendous amounts of resources are expended to prosecute that alleged offense, and the consequences for that person and their family are great. They may be held in custody, away from their family and unable to work, until the case is completed \u2013 even if they are innocent and it takes months (or years) to prove it. Prosecutors, defense attorneys, and judges must dedicate time and energy to ensure a case is fairly and properly heard. And, of course, much \u2013 if not all \u2013 of that work is funded by local governments who were already struggling before COVID-19 ravaged their budgets.<\/p>\n\n\n\n<p>Charging a crime is a hugely consequential decision, and one that must be done thoughtfully. Our criminal legal system is not a cure for the structural racism, predatory capitalism, and other underlying social ills which often fuel delinquent behavior; indeed, data continually shows that \u2013 for many crimes \u2013 prosecution and incarceration actually cause&nbsp;<em>more harm than good&nbsp;<\/em>for individuals, families, and entire communities. In October, 2019, Chicago Appleseed, Chicago Council of Lawyers, The People\u2019s Lobby, and Reclaim Chicago&nbsp;<a href=\"http:\/\/www.chicagoappleseed.org\/wp-content\/uploads\/2019\/10\/2019-10-Report-Kim-Foxx_ForPrint_FINAL.pdf\">published the perspectives of defense attorneys<\/a>&nbsp;who had worked with both Anita Alvarez and Kim Foxx during their tenures as Cook County State\u2019s Attorneys. During Alvarez\u2019s time in office, defense attorneys reported regularly unreasonable behavior by prosecutors in pushing cases forward where there was little-to-no evidence, seeking convictions even in cases where defendants were clearly innocent. This kind of \u201cwin-at-all-costs,\u201d \u201ctough on crime\u201d mentality by prosecutors has been one of the main drivers of mass incarceration in the United States.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The categories of cases\u00a0<a href=\"https:\/\/www.chicagotribune.com\/investigations\/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html\">highlighted in the\u00a0<em>Tribune<\/em>\u2019s August 10 story<\/a>show that SA Foxx is doing exactly what she was elected to do: promote justice in our criminal system and lessen the impact of the system on Chicagoans charged with \u201cnon-violent\u201d crime \u2013 particularly those criminalized for their poverty, mental health and substance abuse issues, or housing instability.<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li><strong><em>NARCOTICS<\/em><\/strong>\u00a0| The State\u2019s Attorney\u2019s dismissal rates in drug cases reflect a major investment in diversion programs. SA Foxx has doubled the use of diversion programs for narcotics cases, which allow people charged with drug offenses to receive community-based treatment and evaluation rather than felony drug charges. This is an unequivocally evidence-based approach to drug-related offenses \u2013 one that should be commended. The war on drugs and the heavy criminalization of drug possession is well known to be the primary driver of unnecessary mass incarceration.<\/li><li><em><strong>\u201cESCAPE\u201d FROM ELECTRONIC MONITORING\u00a0<\/strong><\/em>| Importantly, this charge is misleadingly-named; \u201cescape\u201d does not necessarily mean that someone fled court-ordered supervision or removed their ankle monitor. The \u201cEscape from Electronic Monitoring\u201d statute in Illinois allows the Cook County Sheriff\u2019s Office to ask for a participant to be charged with a Class 3 felony if they allegedly violate the often-draconian rules of the EM program. When the State charges someone\u00a0<em>only<\/em>\u00a0with \u201cEscape,\u201d it means they are<em>\u00a0not accused of committing any felony when they were apprehended<\/em>\u00a0\u2013 their only crime was not following the Sheriff\u2019s rules. These cases where Escape was the only charge were the exact cases that the\u00a0<em>Tribune\u00a0<\/em>examined. The rules of Cook County\u2019s Electronic Monitoring program are untenably restrictive, requiring 72-hour notice for any movement outside one\u2019s home, including for medical appointments and job interviews, and ignores issues of housing instability and any other emergency situation. We commend SA Foxx for using her discretion (the discretion she was elected and has every right to use) to decide when someone should be charged with a felony for allegedly breaking a pretrial monitoring program\u2019s rules without being accused of any other crime.<\/li><li><em><strong>FAILURE<\/strong><\/em>\u00a0<em><strong>TO REGISTER\u00a0<\/strong><\/em>| Sex offender registries are life-long, with extremely restrictive requirements. A person can be arrested for a felony \u201cFailure to Register\u201d charge for missing a deadline, even if they have been otherwise compliant with the requirements for years. When people on the registry are homeless \u2013 a common occurrence because of the restrictions on where people on the registry can live \u2013 by law, they must register in person at a police station\u00a0<em>every 7 days<\/em>\u00a0or risk a felony. Again, State\u2019s Attorney Foxx is absolutely right to use her discretion to only charge violations of the registry that create an\u00a0<em>actual risk<\/em>\u00a0to the community, rather than punishing everyone who fails to comply with harsh, draconian rules.<\/li><li><em><strong>RETAIL THEFT, CREDIT CARD, AND FRAUDULENT ID<\/strong><\/em>\u00a0| These non-violent property crimes are often sent to deferred prosecution programs under SA Foxx\u2019s administration. They are the exact kinds of low-level, \u201cnon-violent\u201d cases that tend to be motivated by poverty and substance issues that SA Foxx has always promised her office would de-prioritize.<\/li><li><strong><em>AGGRAVATED BATTERY OF A PEACE OFFICER<\/em>\u00a0<\/strong>| The\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.chicagotribune.com\/investigations\/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html\" target=\"_blank\"><em>Chicago Tribune<\/em>\u00a0also notes<\/a>\u00a0that under Foxx, the State\u2019s Attorney\u2019s Office has increased dismissals of \u201cAggravated Battery of a Peace Officer\u201d charges. What the article fails to report is that these charges have historically been used as \u201ccover charges\u201d for police brutality \u2013 especially in Chicago. Police have repeatedly avoided charges of brutality (and often a civil rights suit in the long term) by alleging that the arrested person touched them aggressively. The\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.chicagoreporter.com\/chicago-police-use-cover-charges-to-justify-excessive-force\/\" target=\"_blank\"><em>Chicago Reporter<\/em>\u2019s excellent 2018 article<\/a>\u00a0documented this practice extensively. Refusing to be complicit in bad faith charges for \u201cAggravated Battery of a Peace Officer\u201d is exactly what a competent prosecutor should be doing; higher dismissal rates of those charges than others suggests that SA Foxx is making a concerted effort to address this structural problem.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">In short, all the facts the&nbsp;<em>Tribune<\/em>&nbsp;reports in its&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/investigations\/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html\">August 10<\/a><a href=\"https:\/\/www.chicagotribune.com\/investigations\/ct-kim-foxx-felony-charges-cook-county-20200810-ldvrmqvv6bd3hpsuqha4duehmu-story.html\">analysis<\/a>&nbsp;are an excellent sign \u2013 concrete evidence \u2013 that State\u2019s Attorney Foxx has enacted several of the reforms she promised during her campaign.<\/h4>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><a href=\"\"><img decoding=\"async\" loading=\"lazy\" src=\"http:\/\/www.chicagoappleseed.org\/wp-content\/uploads\/2019\/10\/violence-and-jail-1-1019x1024.png\" alt=\"\" class=\"wp-image-12160\" width=\"510\" height=\"512\"\/><\/a><\/figure><\/div>\n\n\n\n<p><strong>Any notion that bond reform or the policies of the Cook County<\/strong>&nbsp;<strong>State\u2019s Attorney have caused a \u201ccrime wave\u201d in Chicago is simply untrue.<\/strong>&nbsp;Interpersonal, community, and systemic violence violence are impediments to human wellbeing in this city, and it is vital that politicians and policy makers continue to prioritize the anti-violence work that has clearly warranted positive results. The intersection of bond reform, justice-focused prosecution, and a movement toward decarceration has led to a sharp drop in crime. In the summer of 2019, the average number of people locked up in Cook County Jail on any given day was 25% lower than it was in 2016; even still, the number of recorded shootings in Chicago from January to August of 2019&nbsp;<a href=\"http:\/\/www.chicagoappleseed.org\/our-blog\/lower-crime-summer-2019\/\" target=\"_blank\" rel=\"noreferrer noopener\">was down 35%<\/a>&nbsp;compared to what it was during the same time period in 2016. Sensationalizing the civil unrest in Chicago may serve political narratives \u2013 acting as a vehicle to propose tougher, more punitive (and continually disproven)&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/opinion\/editorials\/ct-edit-chicago-looting-lightfoot-foxx-20200810-4ilsehywrbb3hfo5tgf6fy26iq-story.html\">\u201ctough on crime,\u201d \u201claw and order\u201d<\/a>&nbsp;policies \u2013 but it absolutely does not serve Chicago\u2019s communities.<\/p>\n\n\n\n<p>If anything, the\u00a0<em>Chicago Tribune\u00a0<\/em>should be using their analysis to recognize the Cook County State\u2019s Attorney\u2019s commitment to fulfilling her electorate\u2019s priorities.\u00a0Reporting on these dismissal rates as if they are a problem, rather than a sign of progress, shows that the\u00a0<em>Tribune<\/em>\u00a0is simply out of step with popular opinion on criminal justice locally and nationally. Kim Foxx just survived a serious Democratic primary challenge focused directly on these so-called \u201ctough on crime critiques.\u201d Foxx defeated her challenger by 19 points \u2013 28 points in the city of Chicago itself.
