{"id":3860,"date":"2021-08-26T21:36:17","date_gmt":"2021-08-26T21:36:17","guid":{"rendered":"https:\/\/chicagocouncil.org\/staging\/1601\/?p=3860"},"modified":"2021-08-26T21:57:22","modified_gmt":"2021-08-26T21:57:22","slug":"response-to-superintendents-attacks-on-the-independence-of-the-judiciary","status":"publish","type":"post","link":"https:\/\/chicagocouncil.org\/staging\/1601\/response-to-superintendents-attacks-on-the-independence-of-the-judiciary\/","title":{"rendered":"Response to Chicago Police Superintendent David Brown&#8217;s Ongoing Attacks on the Independence of the Judiciary"},"content":{"rendered":"\n<p>During a traffic stop on August 7, Chicago Police Department (CPD) Officer Ella French was shot and killed, and her partner was critically wounded. In the wake of this terrible event, emotions are understandably high as Officer French\u2019s colleagues and loved ones continue to grieve and grapple with this tragic loss.<\/p>\n\n\n\n<p>This mourning is no excuse, though, for the latest in CPD Superintendent David Brown&#8217;s ongoing attacks on the independence of the &nbsp;judiciary and its processes\u2014a bedrock of our Democracy. A couple of weeks ago, Superintendent Brown <a href=\"https:\/\/www.chicagotribune.com\/news\/criminal-justice\/ct-chicago-police-shooting-indiana-straw-purchase-hearing-20210811-mq6npwj63vaojazqzzsqruxwoq-story.html\">denounced<\/a> the decision of a federal judge to release the person alleged to have been the \u201cstraw purchaser\u201d of the gun used to kill Officer French. The Superintendent called the decision \u201can outrage,\u201d and \u201ca disservice to Officer French\u2019s memory\u201d and to \u201cthe entire Chicago Police Department.\u201d<\/p>\n\n\n\n<p><strong>The Chicago Council of Lawyers takes strong exception to Superintendent Brown\u2019s comments. We abhor senseless violence and the killing of Officer French, and we fully share the Superintendent\u2019s and the CPD\u2019s commitment to bringing those responsible for her death to justice. Still, the Superintendent\u2019s inflammatory comments represent a threat to the principles of independence of the judiciary and the rule of law, which are indispensable to achieving justice for any victim.<\/strong><\/p>\n\n\n\n<p>Like all accused people, the defendant in this case is entitled to a presumption of innocence, and as of yet, no one knows all of the facts because the case has not reached a resolution. The judge\u2019s decision to release the alleged \u201cstraw purchaser\u201d is consistent with all accepted legal and constitutional standards and is based upon the information presented during the defendant\u2019s appearance. The Superintendent\u2019s comments were wholly inappropriate, have the potential to bias the public, and erode its trust and confidence in our judicial system. In the context of an already volatile climate in our nation\u2019s courtrooms, such comments needlessly increase the threat posed to federal and Cook County judges by disgruntled citizens and litigants.<\/p>\n\n\n\n<p>This is not the first or even second time Superintendent Brown has attacked the bond process. &nbsp;This time, his target was the federal court, but on numerous occasions, the Superintendent has claimed, with no basis in fact, that bond reform is responsible for Chicago\u2019s out-of-control <a href=\"https:\/\/www.chicagoappleseed.org\/2020\/07\/09\/070920-chicago-police-superintendent-wrongfully-blames-gun-violence-on-bond-reform\/\">gun violence<\/a> and an <a href=\"https:\/\/www.wbez.org\/stories\/blaming-chicagos-violence-on-bail-reform-is-wrong-new-study-finds\/dd33c55a-f3da-4d8a-b87b-ae5027d1f044\">increase in crime<\/a>.<\/p>\n\n\n\n<p><strong>Here <em>are<\/em> the facts:<\/strong> As a result of bond and pretrial reforms enacted in 2017, more people have been released pretrial without having to pay monetary bond. These pretrial releases have been tracked and the <a href=\"https:\/\/www.safetyandjusticechallenge.org\/wp-content\/uploads\/2020\/11\/Report-Dollars-and-Sense-in-Cook-County.pdf\">data<\/a> have unambiguously shown that bond reform in Cook County has <em>not<\/em> led to an increase in crime or to new \u201cviolent criminal activity\u201d by those defendants released pretrial.<\/p>\n\n\n\n<p>Superintendent Brown\u2019s repeated, public finger-pointing in pretrial matters has tended to produce more heat than light. Intemperate attacks on the judiciary, such as the statement referenced above, undermine the cause of justice. We urge the Superintendent to bear in mind the words of Cook County Chief Justice Timothy Evans, who <a href=\"https:\/\/www.wbez.org\/stories\/blaming-chicagos-violence-on-bail-reform-is-wrong-new-study-finds\/dd33c55a-f3da-4d8a-b87b-ae5027d1f044\">noted<\/a> last year that \u201cbail reform furthers the cause of justice and equality by releasing defendants not deemed a danger to any person or the public.
