Between 1972 and 1991, Chicago Police Commander Jon Burge&nbsp;<a href=\"https:\/\/books.google.com\/books?id=C-1TDwAAQBAJ&amp;pg=PT243&amp;lpg=PT243&amp;dq=burge+tortured+at+least+119+people,+most+of+whom+were+young+black+men&amp;source=bl&amp;ots=Uo0Yr_Ab40&amp;sig=ACfU3U2VTduOQRCuRv0kpie4wxnmO2iVxQ&amp;hl=en\">tortured at least 119 people \u2013 most of whom were young Black men<\/a>&nbsp;\u2013 in order to force false confessions. Cook County still lives in that legacy: Between January 1989 and December 2013,&nbsp;<a href=\"https:\/\/www.law.umich.edu\/special\/exoneration\/Documents\/Exonerations_in_2013_Report.pdf\">95 people were exonerated<\/a>&nbsp;in Cook County. False confessions accounted for almost&nbsp;<a href=\"https:\/\/www.chicagoreporter.com\/report-cook-county-leads-nation-exonerations-false-confessions\/\">40% of these wrongful convictions<\/a>.<\/p>\n\n\n\n<p>These facts should be of fundamental importance to every lawyer practicing in Cook County and Chicago \u2013 including Mayor Lori Lightfoot. Unfortunately, the Mayor ignored our city\u2019s history and the foundation of our legal system \u2013 the principle that accused people are \u201cinnocent until proven guilty\u201d \u2013 when she stated that \u201cwhen [violent] charges are brought\u2026people are&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/politics\/ct-lightfoot-chicago-bail-violent-offenders-reform-20220606-ljwmmndjrzhc7lyjewxis46sf4-story.html\">guilty<\/a>.\u201d<\/p>\n\n\n\n<p>Mayor Lightfoot\u2019s comments were&nbsp;<a href=\"https:\/\/www.chicagoappleseed.org\/2021\/12\/21\/public-safety-proposals-by-chicagos-mayor-are-unconstitutional-and-not-based-in-fact\/\">yet another<\/a>&nbsp;attack on the&nbsp;<a href=\"https:\/\/endmoneybond.org\/pretrialfairness\/\">Pretrial Fairness Act<\/a>, which will abolish money bail (among other things) starting in 2023. This policy is absolutely essential to ensure that people in Illinois are no longer jailed because they are poor. Pretrial jailing ruins people\u2019s lives by taking them away from their homes, spouses, children, and jobs. More people plead guilty when they\u2019re held in jail before trial, and pretrial jailing leads to&nbsp;<a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2016\/07\/why-pretrial-jail-can-mean-pleading-to-worse-crimes\/491975\/\">longer sentences<\/a>&nbsp;in general. Data shows that people jailed \u201cfor as little as 72 hours\u201d are over&nbsp;<a href=\"https:\/\/www.chicagotribune.com\/opinion\/commentary\/ct-opinion-memorial-day-gun-violence-safe-t-act-money-bonds-20220525-ubwsczl5k5d53lk3t6ospvfriu-story.html\">two-times more likely to be unemployed<\/a>&nbsp;the following year.<\/p>\n\n\n\n<p><strong>Not only is mandatory pretrial jailing unconstitutional, but&nbsp;<\/strong><a href=\"https:\/\/www.chicagoappleseed.org\/2021\/01\/28\/long-waits-for-justice-cook-county-criminal-court-backlog\/\"><strong>over a quarter<\/strong><\/a><strong>&nbsp;(27%) of felony cases in Cook County are dismissed entirely. We ask: How can anyone justify calling for&nbsp;<\/strong><strong><em>everyone<\/em><\/strong><strong>&nbsp;<\/strong><strong><em>charged with certain felonies<\/em><\/strong><strong>&nbsp;to be jailed pretrial when these are the facts?&nbsp;<\/strong><\/p>\n\n\n\n<p>Chicago Appleseed Center for Fair Courts and the Chicago Council of Lawyers urge Mayor Lightfoot to back away from these harmful statements. All people deserve access to their rights \u2013 especially those as foundational as the presumption of innocence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cook County&nbsp;leads the nation&nbsp;in exonerations based on false confessions.
